Deficiencia regulatoria del error judicial inexcusable como violación al derecho de acceso a la justicia

    En este trabajo se plantea sostener que las deficiencias regulatorias del error judicial inexcusable en México implican una merma en el derecho de acceso a la justicia de los ciudadanos. Para tal efecto, con apoyo de los métodos descriptivo y analítico, se estudia la figura del error judicial a fin de proporcionar una definición, los sujetos que intervienen causas y tipos en los que se puede manifestar. Esto con el fin de contar con los elementos necesarios para comprender, en términos generales, cuáles son los alcances y el tratamiento normativo en el sistema jurídico mexicano del error judicial inexcusable como una forma de responsabili-dad patrimonial del Estado. De esta forma, se concluye que en México existe una nula regulación sobre dicha figura lo que impide a los justiciables obtener una indemnización por error judicial y, en consecuencia, repercute repercuten negativamente en el derecho de acceso a la justicia.

    This paper proposes to argue that the regulatory deficiencies of the inexcusable judicial error in Mexico imply a reduction in the right of access to justice for citizens. For this purpose, with the support of descrip-tive and analytical methods, the figure of judicial error is studied to provide a definition, the subjects involved, causes and types in which it can manifest. This to have the necessary elements to understand, in general terms, what are the scope and regulatory treatment in the Mexican legal system of inexcusable judicial error as a form of State patrimonial responsibility. In this way, it is concluded that in Mexico there is no regulation on this figure, which prevents defendants from obtaining compensation for judicial error and, consequently, has a negative impact on the right of access to justice.
