Al Parlamento Andino se le ha entregado la responsabilidad derepresentar a los pueblos de los Países Miembros de laComunidad Andina. No obstante, parecería que su lugardentro del Sistema Andino de Integración no es del todo claro,pues muy a pesar de su nombre no legisla, y susrecomendaciones y sugerencias no tienen fuerza de ley ni sonvinculantes. El artículo expone cómo el Tribunal de Justicia dela Comunidad Andina, a través de sus sentencias einterpretaciones prejudiciales, ha dado forma al ParlamentoAndino, definiendo, entre otros aspectos, su lugar en elordenamiento jurídico comunitario, la relación laboral quemantiene con los parlamentarios, y hasta la relaciónadministrativa que existe entre su oficina central y sus oficinasde representaciones nacionales.

The Andean Parliament has been given the responsibility ofrepresenting the peoples of the Member Countries of theAndean Community. However, its place within the AndeanIntegration System is not entirely clear since, despite its name,it does not legislate, and its recommendations and suggestionsdo not have the force of law neither are binding. The articleexplains how the Court of Justice of the Andean Community,through its sentences and preliminary rulings, has shaped theAndean Parliament, defining, among other aspects, its place inthe community legal system, the labor relationship thatparliamentarians have, and even the administrative relation that exists between the central office and the nationalrepresentation offices that are based in the countries of theAndean Community
