    El trabajo tiene como objeto delimitar el ius puniendi de las entidades deportivas en España después de la aprobación de la Ley 39/2022, del 30 de diciembre, Ley del Deporte. Asimismo, como cuestión previa y necesaria, se aborda la discutida la naturaleza jurídica de las federaciones españolas y ligas profesionales. Al respecto, se sostiene en el escrito que las federaciones españolas y ligas profesionales tienen naturaleza privada y que la distinción que se hace en la Ley 39/2022 entre funciones públicas y privadas de las federaciones españolas aparece equívoca, exponiendo cuál es el criterio de delimitación entre su ius puniendi privado y el del Estado

    This paper analyses the delimitation between the ius puniendi of sports entities in Spain following the enactement of the new Act 39/2022, dated December 30, on Sports. As a preliminary matter, it discusses the legal nature of Spanish federations and professional leagues. It maintains that Spanish federations and professional leagues are inherently private entities, and argues that the distinction made in Law 39/2022 between the public and private functions of Spanish federations seems misleading. Furthermore, it explains the criteria for distinguishing between their private ius puniendi and that of the State
