    La sentencia considera válidas las previsiones estatutarias de sumisión al arbitraje para resolver las contiendas entre propietarios en el ámbito del régimen especial de la Propiedad Horizontal, si bien en una interpretación sistemática del contrato litigioso, en el que se contiene la cláusula de sumisión a dicho instituto, estima que no se buscaba elevarla a la categoría de cláusula estatutaria aplicable al edificio que se habría de construir sometido al referido régimen especial, sino que la sumisión al arbitraje lo era sólo para dirimir las discordias que pudieran surgir entre los firmante del contrato como negocio por el que se pactaba la demolición de dicha edificación y la construcción de una nuevo en su lugar.

    The judgment considers the statutory provisions on submission to arbitration to resolve disputes between owners within the scope of the special regime of Horizontal Property to be valid, although in a systematic interpretation of the contract in dispute, in which the clause on submission to arbitration is contained, it considers that the aim was not to elevate it to the category of statutory clause applicable to the building to be constructed under the aforementioned special regime, but only to settle disputes between owners, it considers that it was not intended to be elevated to the category of a statutory clause applicable to the building to be constructed under the aforementioned special regime, but that the submission to arbitration was only to settle disputes that might arise between the signatories of the contract as a business by which the demolition of the said building and the construction of a new one in its place was agreed.
