    Cuando la pareja marital se mantiene firmemente anclada en la permanencia de su vínculo conyugal, esa “conyugalidad” es la verdadera protagonista de la solidaridad familiar en el seno del cada vez más reducido núcleo familiar hasta el fallecimiento de uno de sus miembros. Por ello, no resulta nada conveniente desatender esta realidad que el legislador se resiste a reconocer y favorecer como merece. Máxime si atendemos a la posible avanzada edad del supérstite, probable discapacidad y/o situación económica no muy boyante. Así pues, en este análisis se plantea la revisión de los escasos derechos sucesorios del cónyuge supérstite y la limitada libertad de testar en este aspecto, teniendo en cuenta las trasformaciones de la familia española en los últimos decenios y, especialmente, de la relación marital que subsiste pese al aumento de las crisis conyugales y consiguientes divorcios de los tiempos actuales.

    When the marital couple remains firmly anchored in the permanence of their marital bond, that “conjugality” is the true protagonist of family solidarity within the increasingly reduced family nucleus, until the death of one of its members. Which it’s why it is not convenient to ignore this reality that the legislator refuses to recognize and favor as it deserves. Especially if we consider the possible old age of the survivor, probable disability and/or not very buoyant economic situation. Thus, in this analysis the review of the scarce inheritance rights of the surviving spouse and the limited freedom of will in this aspect is proposed, taking into account the transformations of the Spanish family in recent decades and, especially, of the marital relationship that persist despite the increase in marital crises and subsequent divorces in the current times.
