Resumen de El accionar de las instituciones de la Unión Europea en la protección de los derechos de las personas LGBTIQ+: los casos de Hungría y Polonia

Ante la extensión de discursos de odio y el ascenso de partidos de extrema derecha en la Unión Europea (UE), este artículo explora el accionar de las instituciones del proceso de integración europeo para proteger a la comunidad LGBTIQ+ puntualmente frente a lo acontecido en Hungría y Polonia. Primeramente, se analizan tanto las disparidades en el reconocimiento de derechos de las diversidades sexuales en los Estados miembros como la aceptación en la sociedad europea. Seguidamente se presentan los instrumentos jurídicos con los que la UE puede defender a las personas LGBTIQ+. Por último, se analizan las acciones que han llevado adelante tres de las instituciones de la UE, a saber, la Comisión Europea, el Parlamento Europeo y el Tribunal de Justicia de la Unión Europea. Todo esto permitirá concluir que, aun con sus limitaciones, la UE se ha constituido como un contrapeso al accionar anti-LGBTIQ+ de algunos gobiernos de extrema derecha.

Given the spread of anti-LGBT speech and the rise of far-right parties in the European Union (EU), this article explores the actions of the institutions of the European integration process to protect the LGBTIQ+ community against the actions of the governments of Hungary and Poland. Firstly, both the disparities in the recognition of rights of sexual diversities in the States and the acceptance in European society are analyzed. Then, the legal instruments with which the EU can defend diverse sexual identities are presented. Finally, the actions carried out by three of the EU institutions are analyzed, namely the European Commission, the European Parliament and the Court of Justice of the European Union. This will allow to reach the conclusion that the UE has become a counterweight that deters the anti-LGBT actions of some far-right governments.
