Resumen de Percepción sobre la virtualización post COVID-19 de los procesos judiciales

Las medidas adoptadas para enfrentar la pandemia del covid-19 afectaron a todos los actores de un proceso judicial. Los operadores judiciales, los abogados litigantes y los funcionarios de entidades como la Personería o la Contraloría, que interactúan constantemente en dichos procesos, se vieron interpelados por la situación de tal forma que tuvieron que modificar sus hábitos laborales. Más allá de esto, los cambios mencionados pusieron en riesgo la capacidad del Estado para garantizar el debido proceso, por cuanto se exigió el uso de herramientas tecno-lógicas. En este artículo se analiza la percepción de los actores del proceso judicial frente a su virtualización mediante una revisión bibliográfica y una entrevista semiestructurada a tres tipos de profesionales que hicieron parte de procesos judiciales durante esta época. Ahora bien, la principal conclusión es que existe una percepción común respecto al concepto de justicia y de los problemas que enfrenta la administración de justicia, salvo la del operador de justicia, pues este la relaciona con el cumplimiento de su deber. Así mismo, los entrevistados coinciden en que la nueva legislación en materia de virtualización de los procesos judiciales no promete resolver los problemas que enfrenta la administración de justicia, como son la congestión, la falta de personal capacitado en medios digitales y la estandarización de la información adquirida por dichos canales.

The measures adopted in response the COVID-19 pandemic affected all the different parts conforming a judicial process. The operators of the judicial system, the litigious attorneys, and the members of governmental entities such as the “Personería” and “Contraloría”, who constantly interact with said processes, saw themselves challenged by the situation in a way that had their legal ways change. Beyond this, the mentioned changes risked the State’s capability to guarantee the due process, since the use of technological tools was demanded. In this article, the perception of the different parts of the judicial process, regarding its virtualization, is analyzed. This done by studying bibliography and conducting a semi-structured interview to three different types of professionals who took part in judicial processes throughout the pandemic. Therefore, the principal conclusion is that there is a common perception in regards the concept of justice, as well as to the issues the justice administration faces, excepting the one from the members of the judicial system, since it is related to fulfillment of its tasks. Also, the interviewees agreed on that the new legislation regarding the judicial processes’ virtualization does not promise to solve the issues faced by the justice administration; problems such as: congestion, lack of manpowerschooled in digital technologies and the standardization ofthe information gathered by said technologies.
