La reciente STC, Sala Segunda, N.o 40/2024, de 11 de marzo, aborda la controvertida cuestión de los traslados de conductores investigados por circular bajo la influencia de alcohol a dependencias policiales a fin de ser sometidos a las pruebas de detección de sustancias. Una operativa carente de regulación legal que puede afectar tanto a la libertad individual (art. 17 CE) como a la presunción de inocencia (art. 24 CE).
The recent judgement delivered by the Spanish Constitutional Court (2nd Chamber, n.o 40/2024, March 11th) addresses the problematic issue concerning transfer of drunk drivers (who are not formally under «police custody») to police stations by officers who lack of specific traffic competence in order to use the alcohol detection tools and confirm whether de results are criminally relevant or not. Such a practice that lacks of legal backup and may violate the right of freedom and presumption of innocence.
