En situaciones de insolvencia cercanas a esta, los actos de negociación preconcursal entre el deudor y sus acreedores tienen lugar sin que se haya iniciado un proceso jurisdiccional, pero se desenvuelven en conexión con la órbita judicial. Así lo acredita que, tanto al principio como a lo largo del desarrollo de esa actividad negocial y, sobre todo, al final, puede tener lugar la intervención de un órgano jurisdiccional con diversos fines. Evidentemente, en esas actuaciones ante los tribunales puede haber conflicto entre partes interesadas y, entre los elementos de ese conflicto, no ha de ser infrecuente que existan aspectos facticos controvertidos. El objeto de este trabajo es reflexionar sobre que parte procesal es la que debe asumir la carga formal y material de la prueba y sobre dónde debería estar situado el grado de convicción judicial respecto de las diversas circunstancias fácticas que se discutan.
In situations of insolvency or close to it, preventive restructuring negotiations take place mainly out of court, but in connection with the judicial sphere. Both at the beginning and throughout the development of this negotiation activity and, above all, at the end, the intervention of a court may take place for various purposes. During these proceedings before the courts, there may be conflict between interested parties and, among the elements of this conflict, it is not uncommon for there to be disputed factual aspects. The purpose of this paper is to reflect on which party should bear the formal and material burden of proof and where the degree of judicial conviction should lie with respect to the various factual circumstances in dispute.
