    El proceso de construcción estatal constituye el ineludible telón de fondo para analizar algunos aspectos de la criminalidad femenina y sus transformaciones en los discursos y consideraciones acerca de la mujer y su papel en la sociedad. En este caso, la propuesta es abordar los casos de infanticidio en la provincia de San Juan y cómo fue cambiando el castigo para este delito a la luz de las numerosas leyes, teorías y aplicación de la normativa en un Estado en permanente transformación. A través del análisis de los juicios de infanticidios ocurridos entre 1853 y 1922, podemos observar las transformaciones del aparato legal de justicia y punitivo de un estado que comenzaba a constituirse como tal. También los casos judiciales nos permiten identifi car los cambios con relación al control social de los cuerpos, las relaciones familiares y la mujer como madre, así como complejo entramado social que se pone de manifi esto a través de las voces de los sujetos subalternos de los procesos judiciales

    The process of building a state constitutes the unavoidable backdrop to analyse the female crime and its transformations in the discourses and considerations on women and their roles in the society. In this case, the proposal is to tackle the cases of infanticide in the province of San Juan and how the penalty to this crime has changed in the light of the numerous laws and criminology theories in a State of continuous transformation.

    Within the analysis of trials of infanticide occurred between 1853 and 1922, we can see the transformations of the legal and punitive apparatus of justice in an estate that started to constitute itself. Also, the court cases allow us to identify the changes in relation to the social control of the bodies, the family relationships and the women as mothers, as well as the complex social framework that shows itself through the voices of the subaltern subjects in the judicial proceedings.
