Conflictos olvidados en Medio Oriente: la falta de empatía de la comunidad internacional a la luz del Derecho Internacional Humanitario

    Esta investigación pretende realizar una reflexión sobre los vacíos sustanciales que aún existen en torno a la utilización del Derecho Internacional Humanitario, su verdadera función, y aplicabilidad en entornos como Medio Oriente, donde el análisis de su validez permite cuestionar acerca de su neutralidad. Por ende, para poder desarrollar esta reflexión, principalmente se realiza un cuestionamiento acerca de la importancia que la guerra genera para la comunidad internacional; es decir, si estos sucesos son asuntos de primera necesidad para la misma, dependiendo del lugar o los actores quienes se vean involucrados.  Posteriormente, se evidencia una comparación entre los sucesos que iniciaron los conflictos en Medio Oriente, su continuación y empeoramiento a lo largo de la historia hasta el día de hoy, para finalmente, desde el derecho internacional humanitario, poder observar qué pronunciamiento ha tenido la comunidad internacional sobre estos conflictos y qué se ha hecho para poder solucionarlos.  Con esto, se intenta concluir, a modo de cuestionamiento, sobre la verdadera utilidad de organismos internacionales como las Naciones Unidas, órganos judiciales como la Corte Internacional de Justicia y tribunales como la Corte Penal Internacional, del rol que cumplen dentro del sistema internacional y la importancia que para estos tiene el amparo y respeto por los derechos humanos en escenarios como el Medio Oriente.

    This research aims to reflect on the substantial gaps that still exist regarding the utilization of international humanitarian law, its true function, and applicability in environments such as the Middle East, where analyzing its validity raises questions about its neutrality. Therefore, in order to develop this reflection, there is primarily a questioning about the importance that warfare holds for the international community; that is, whether these events are matters of utmost necessity for it, depending on the location or the actors involved.

    Subsequently, a comparison is made between the events that triggered conflicts in the Middle East, their continuation, and worsening throughout history up to the present day. Finally, from the perspective of international humanitarian law, an examination is conducted of the international community's stance on these conflicts and what has been done to resolve them.

    With this, the aim is to conclude, as a form of questioning, about the true utility of international organizations like the United Nations, judicial bodies like the International Court of Justice, and institutions like the International Criminal Court. It questions the role they play within the international system and the significance they attribute to safeguarding and respecting human rights in scenarios like the Middle East.
