Resumen de Das “Quatro Liberdades” à Declaração Universal dos Direitos Humanos: uma análise sobre a relativização da liberdade de expressão no Inquérito nº 4.781 (Inquérito das “Fake News”) pelo Supremo Tribunal Federal

  The present work has as its main theme the right to Freedom of Expression, but specifically, it analyzes the relativization of this fundamental right in Inquiry nº 4.871 (Fake News” Inquiry), together with ADPF nº 572. Four Freedoms speech, delivered on January 6, 1941, by US President Franklin D. Roosevelt before the US Congress. Then, we focus on the Universal Declaration of Human Rights that inaugurated the universalization of Human Rights. It also addresses the history, the power of self-determination and limits of Freedom of Expression in the Constitution of the Federative Republic of Brazil. At the end of this work, we conclude that the right to Freedom of Expression is not absolute, however, it is possible to establish that the conduct of the Brazilian Supreme Court in the course of this Inquiry nº 4.781, presents several unconstitutional points.

  O presente trabalho tem como tema principal o direito à Liberdade de Expressão, mas especificamente, analisa a relativização desse direito fundamental no Inquérito nº 4.871 (Inquérito das “Fake News”), juntamente com a ADPF n º 572. Partimos do memorável “Discurso das Quatro Liberdades” (“Four Freedoms speech”), proferido em 6 de janeiro de 1941, pelo Presidente dos Estados Unidos Franklin D. Roosevelt perante o Congresso norte--americano. Em seguida, nos debruçamos sobre a Declaração Universal dos Direitos Humanos que inaugurou a universalização dos Direitos Humanos. Aborda-se também, o histórico, o poder de autodeterminação e os limites da Liberdade de Expressão na Constituição da República Federativa do Brasil. Ao final deste trabalho, concluímos, que o direito à Liberdade de Expressão nãoé absoluto, entretanto, é possível estabelecer que as condutas da Suprema Corte brasileira no curso desse Inquérito nº 4.781, apresenta diversos pontos inconstitucionais.
