La inconvencionalidad de la causal de improcedencia prevista en la fracción I del artículo 61 de la Ley de amparo

    La presente investigación es un estudio dogmático-jurídico, en la que se examina la fracción I  del artículo 61 de la Ley de Amparo, derivada de la reforma publicada en el Diario Oficial de la Federación de fecha dos de abril de dos mil trece, en la que se establece que el juicio de amparo es improcedente contra adiciones o reformas a la Constitución General, trabajo legislativo que se considera inconvencional por que contiene una restricción frente al derecho humano a una tutela judicial efectiva y a las garantías judiciales, desatendiendo la necesidad y proporcionalidad de la medida restrictiva. Se observará que existe un medio de defensa legal efectivo, los justiciables no puedan acceder a él, por lo que se concluye una necesaria reforma a la fracción I del artículo 61 de la Ley de Amparo.

    This research is a dogmatic-legal study, in which section I of article 61 of the Amparo Law is examined, derived from the reform published in the Official Gazette of the Federation on April 2, two thousand thirteen, in the one that establishes that the amparo judgment is inadmissible against additions or reforms to the General Constitution, legislative work that is considered unconventional because it contains a restriction on the human right to effective judicial protection and judicial guarantees, disregarding necessity and proportionality of the restrictive measure. It will be observed that there is an effective means of legal defense, the defendants cannot access it, therefore a necessary reform of section I of article 61 of the Amparo Law is concluded.
