Resumen de La justicia debe ser tuerta

  A través del presente trabajo se pretende acreditar la importancia de la experticia a la hora de realizar las periciales sociales; concretamente en el caso de la Ley 8/2021, 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica.

  Y es que resulta absolutamente necesario poner de relevancia el papel tan importante que ésta y otras leyes están dando a los y las trabajadoras sociales que ejercen su labor como peritos sociales que, más allá de tener el título oficial, deben, además, tener especialización en la materia para poder garantizar los Derechos Humanos, incluidos los derechos sexuales y reproductivos, de las personas peritadas venciendo la inercia propia del ámbito jurídico.

  Through this work, the aim is to highlight the importance of expertise when con- ducting expert social assessments, specifically in the case of Law 8/2021, June 2nd, which reforms civil and procedural legislation to support people with disabilities in the exercise of their legal capacity.

  It is absolutely necessary to highlight the crucial role that this and other laws are granting to social workers who perform their work as social experts, who, beyond having the official title, must also have expertise in the field in order to guarantee Human Rights, including sexual and reproductive rights, of the individuals being assessed, overcoming the inertia inherent in the legal sphere.
