    El reciente accidente mortal en las obras de rehabilitación de la mina subterránea romana de Limaria o Los Espejue-los, en Arboleas (Almería), el primero conocido en esta actividad, trae a la actualidad, por una parte, el asunto de cuál ha de ser la legislación de referencia para el caso y, por otra, quién es la Autoridad competente en materia de seguridad en tales trabajos y espacios que, además, debe investigar el accidente. Descrito el marco en donde ocurrió el accidente y las circunstancias de éste, teniendo en cuenta que se estaba aplicando técnica minera en los trabajos, se concluye que la normativa que debe tomarse como referencia es la minera y, en cuestiones meramente laborales, la de prevención de riesgos adaptada al sector.Además, en la investigación del accidente, la Autoridad Minera es la competente.

    The recent fatal accident in the rehabilitation of the Roman underground mine of Limaria or Los Espejuelos, in Ar-boleas (Almería), the first known in this activity, brings to the present the issue of what should be, on the one hand, the legislation of reference for the case and, on the other, the competent authority in matters of safety in such works and spaces, which must also investigate the accident. Having described the framework in which the accident occurred and its circumstances, taking into account that mining techniques were being applied in the works, it is concluded that the regulations that should be taken as a reference are mining and, in purely labor matters, prevention of risks adapted to the sector. On the other hand, in the investigation of the accident, the competence falls on the Mining Authority.
