Access to the documentary collections of the repression related to the Franco regime in our country has often been plagued with bothlegal and material obstacles, which the Law 52/2007 on Historical memory could not or would not smooth over. The new Democratic Memory Law 20/2022, on the other hand, although maintaining a continuing character in some issues, contains significant innovations mainly derived from the recognition of the right to the truth, not only for the victims, but for society as a whole, with direct consequences on historical research.

El acceso a los fondos documentales de la represión del Régimen franquista ha estado en nuestro país plagado de obstáculos legales y materiales, que la Ley 52/2007 de Memoria Histórica no supo (o quiso) allanar. Por su parte, la nueva Ley 20/2022 de Memoria Democrática, si bien es continuista en algunas cuestiones, en otras contiene novedades significativas derivadas, principalmente, del reconocimiento del derecho a la verdad, no solo a las víctimas, sino a la sociedad general, con consecuencias directas en relación con la actividad de investigación histórica.
