    Este trabalho teve como foco entender a situação constitucional israelense, considerando a ausência de um documento formal intitulado "Constituição" do país. A ideia foi estudar os elementos do direito na teoria - e, dentro do possível, na prática - da sociedade israelense, e identificar possíveis semelhanças com o brasileiro. Partindo do conceito de constituição atual e das principais teorias, a Parte I traz uma abordagem teórica do constitucionalismo ocidental nos últimos séculos. A evolução da ideia de constituição, desde as principais Revoluções (Puritana, Francesa e Americana), e como influenciaram no conceito atual. Ademais, está presente um breve estudo sobre o Estado Democrático de Direito, e a sua relação com a existência e necessidade de um documento que possua todas as garantias de direitos dos indivíduos em cada país. Parte II é focada em Israel. Como funciona a sua democracia - peculiar, considerando a influência religiosa -, quais organismos fazem parte de sua estrutura, se existem mecanismos de controle e quais são eles. Quais as fontes do direito e como se organizam, bem como qual a relação que realmente existe entre religião e democracia no país. Ainda, esta parte do trabalho traz uma noção do contexto em que estava inserido Israel antes de se constituir como país - o fim do Mandato Britânico e as guerras que se seguiram. A parte histórica é de extrema importância para que se entenda melhor os rumos que a democracia israelense tomou, até os dias de hoje. Por meio do levantamento bibliográfico, de sua compreensão e profundo estudo foi possível a realização do trabalho - e sua conclusão na terceira parte - que abrange também minha tese sobre a situação constitucional de Israel (as Leis Básicas substituem uma constituição formal), em uma análise em comparação com o Brasil, a partir do que foi estudado.

    This paper focused on understanding the Israeli constitutional situation, considering the absence of a formal document entitled "Constitution" in the country. The idea was to study the elements of law in theory -and, as far as possible, in practice -of the Israeli society, and to identify possible similarities with the Brazilian one. Starting from the current concept of constitution and the main theories, Part I brings a theoretical approach to Western constitutionalism in the last centuries. The evolution of the idea of constitution, since the main Revolutions (Puritan, French and American), and how they influenced the current concept. Furthermore, there is a brief study on the Democratic Rule of Law, and its relation to the existence and necessity of a document that has all the guarantees of the rights of individuals in each country. Part II is focused on Israel. How its democracy works -peculiar, considering the religious influence -, which bodies are part of its structure, if there are control mechanisms and what they are. What are the sources of law and how are they organized, as well as what is the real relation between religion and democracy in the country. Furthermore, this part of the paper gives a sense of the context in which Israel was inserted before it was constituted as a country -the end of the British Mandate and the wars that followed. The historical part is of extreme importance in order to better understand the paths that the Israeli democracy has taken, until today. Through the bibliographical survey, its comprehension and deep study it was possible to carry out the work -and its conclusion in the third part -which also includes my thesis on the constitutional situation in Israel (the Basic Laws substitute a formal constitution), in an analysis in comparison with Brazil, based on what was studied.
