  El objetivo general de la investigación fue analizar jurídicamente la participación y autoría de los niños, niñas y adolescentes en bandas delictivas. La presente investigación utilizó el método cuantitativo el cual produce datos descriptivos, que se originan por la recolección de datos. Apoyado en la revisión documental-bibliográfica. Además, se aplicó el método inductivo-deductivo. Se planteó además el método analítico-sintético. Se aplicó una encuesta, a los abogados, jueces y personas de la comunidad científica conocedores acerca de la participación y autoría de los niños, niñas y adolescentes en bandas delictivas en el Ecuador a un total de 30 personas. Se concluye que, se evidencia la vulnerabilidad en los derechos de los niños, niñas y adolescentes que participan y forman parte de bandas delictivas. Por otra parte, el gobierno y la sociedad debe contribuir en la disminución del índice de criminalidad e inseguridad existente a nivel provincial y nacional.

  The general objective of the research was to legally analyze the participation and authorship of children and adolescents in criminal gangs. This research used the quantitative method, which produces descriptive data, originating from data collection. It was supported by a documentary-bibliographic review. In addition, the inductive-deductive method was applied. The analytical-synthetic method was also used. A survey was applied to lawyers, judges and people from the scientific community with knowledge about the participation and authorship of children and adolescents in criminal gangs in Ecuador, to a total of 30 people. It is concluded that the vulnerability of the rights of children and adolescents who participate and form part of criminal gangs is evident. On the other hand, the government and society must contribute to the reduction of crime and insecurity at the provincial and national levels.
