Resumen de La muerte cruzada: percepciones, incidencias y repercusiones en la estructura constitucional del Estado ecuatoriano

  El objetivo general de la investigación fue analizar jurídicamente la muerte cruzada: Percepciones, incidencias y repercusiones en la estructura constitucional del Estado ecuatoriano. La presente investigación utilizó el método cuantitativo el cual produce datos descriptivos, que se originan por la recolección de datos. Apoyado en la revisión documental-bibliográfica. Además, se aplicó el método inductivo-deductivo. Se planteó además el método analítico-sintético. Se aplicó una encuesta, con una muestra de 10 personas profesionales de derecho constitucional. Se concluye que, la presidenta o presidente de la República podrá disolver la Asamblea Nacional cuando, a su juicio ésta se hubiera arrogado funciones que no le competan constitucionalmente, previo dictamen favorable de la Corte Constitucional; o si de forma reiterada e injustificada obstruye la ejecución del Plan Nacional de Desarrollo o por grave crisis política y conmoción interna.

  The general objective of the research was to carry out a legal analysis of cross-death: Perceptions, incidences and repercussions in the constitutional structure of the Ecuadorian state. This research used the quantitative method, which produces descriptive data, originating from data collection. Supported by the documentary-bibliographic review. In addition, the inductive-deductive method was applied. The analytical-synthetic method was also used. A survey was carried out with a sample of 10 constitutional law professionals. It is concluded that the President of the Republic may dissolve the National Assembly when, in his or her opinion, it has assumed functions that do not fall within its constitutional competence, following a favourable opinion from the Constitutional Court; or if it repeatedly and unjustifiably obstructs the execution of the National Development Plan or due to a serious political crisis and internal commotion.
