    Se analizan las implicaciones de la acción de extinción de dominio sobre el régimen constitucional de la propiedad en Venezuela, a propósito de la promulgación de la Ley Orgánica que regula esa incipiente institución en nuestro Derecho, haciendo especial referencia a su naturaleza jurídica, límites, el principio de buena fe, presunción de inocencia, lo relativo a la retrospectividad e imprescriptibilidad, así como el tratamiento que dicha figura ha tenido en el derecho comparado y el orden constitucional de los tratados internacionales que sobre la materia ha suscrito Venezuela.

    The implications of the domain extinction action on the constitutional regime of property in Venezuela are analyzed, regarding the promulgation of the Organic Law that regulates this incipient institution in our Law, making special reference to its legal nature, limits, the principle of good faith, regarding retrospectivity and imprescriptibility, as well as the treatment that said figure has had in comparative law and the constitutional order of the international treaties that Venezuela has signed on the matter.
