Generalidades del contrato de compraventa comercial y su importancia para el Derecho comercial

    El presente artículo abordó el contrato de compraventa comercial, sus generalidades, regulación principal en el Derecho panameño y su importancia para el Derecho comercial.   En un primer momento se realiza la delimitación conceptual de la figura del contrato de compraventa.  Posteriormente se efectuó un análisis de la normativa panameña vigente sobre la materia. Específicamente las regulaciones del Código de Comercio.  Del análisis normativo se desprenden las principales reglas que rigen este contrato pero además la delimitación del mismo, definiendo que tipo de compraventas se encuentran en la esfera comercial y cuales en la esfera civil.  La normativa fue analizada utilizando el método exegético de análisis jurídico.  Entre las condiciones a las que llega el artículo se desprende que existe una enorme importancia para el Derecho comercial, del estudio del contrato de compraventa, pues este se encuentra ligado a los propios orígenes y desarrollo actual del comercio y por ende del Derecho comercial.

    This paper addressed the commercial purchase and sale contract, its generalities, main regulation in Panamanian Law and its importance for commercial Law. At first, the conceptual delimitation of the figure of the purchase and sale contract is made. Subsequently, an analysis of the current Panamanian regulations on the matter was carried out. Specifically the regulations of the Commercial Code. From the regulatory analysis, the main rules that govern this contract emerge, but also its delimitation, defining which types of sales are in the commercial sphere and which are in the civil sphere. The regulations were analyzed using the exegetical method of legal analysis. Among the conditions reached in the article, it is clear that there is enormous importance for commercial law in the study of the purchase and sale contract, since this is linked to the very origins and current development of commerce and therefore commercial law.
