    El presente trabajo analiza la necesidad de establecer un plazo específico a la imputación fiscal, como acto inicial de la etapa preparatoria, dentro del proceso penal y propone un plazo razonable para la ejecución de la imputación evitando la incertidumbre y la vulneración del derecho a la defensa por indeterminación del mismo. Este acto marca el punto de partida del proceso adversarial cesando la investigación preliminar del órgano acusador, a partir de la cual el sindicado podrá oponer defensa al progreso de las investigaciones. A tal efecto se analizó expedientes judiciales, se aplicó encuestas y entrevistas a abogados, jueces y fiscales a fin de obtener una visión amplia acerca del establecimiento del plazo para la imputación dentro de la ley instrumental.

    The present work analyzes the need to establish a specific term for the tax imputation, as an initial act of the preparatory stage, within the criminal process and proposes a reasonable term for the execution of the imputation avoiding the uncertainty and the violation of the right to defense by indetermination thereof. This act marks the starting point of the adversarial process by ceasing the preliminary investigation of the accusing body, from which the accused may defend the progress of the investigations. For this purpose, judicial files were analyzed, surveys and interviews were conducted with lawyers, judges and prosecutors in order to obtain a broad view about the establishment of the deadline for imputation within the instrumental law.
