Derechos humanos, redes sociales y protección judicial: Criterios para resolver conflictos entre derechos a la luz de las obligaciones internacionales del Estado

    Este artículo analiza los conflictos entre derechos humanos que se presentan en el marco del uso de las redes sociales. Se reseña la normativa vigente, de orden constitucional y legal; se analiza la jurisprudencia en dos temas relevantes, como son, el derecho al olvido y las funas; y, finalmente, se proponen algunos criterios para la resolución de casos en la justicia nacional a fin de que esta se adecúe a los estándares internacionales en materia de libertad de expresión. El estudio busca demostrar los déficits en la legislación y en la interpretación judicial que están impidiendo un pleno goce y ejercicio de la libertad de expresión a través de las redes sociales en Chile y proponer algunos criterios que permitirían superar esta situación.

    This article analyzes the conflicts between human rights that arise in the context of the use of social networks. The current constitutional and legal regulations are reviewed; the jurisprudence is analyzed on two relevant topics, such as the right to be forgotten and funas or scratch; and, finally, some criteria are proposed for the resolu-tion of cases in the national justice system so that it adapts to international standards on freedom of expression. The study seeks to demonstrate the deficits in legislation and judicial interpretation that are preventing the full enjoyment and exercise of freedom of expression through social networks in Chile and proposes some criteria that would allow this situation to be overcome.
