La reforma del artículo 49 de la Constitución sobre discapacidad: una vulneración del derecho a la igualdad del artículo 14 de la Carta Magna

    El 17 de febrero de 2024 se ha publicado en el BOE el nuevo tenor del artículo 49 de la Constitución, que va más allá de la sustitución del término “disminuido” por discapacitado, pues introduce un mandato de especial protección de la mujer, una suerte de discriminación positiva que no se justifica en la Proposición conforme a la jurisprudencia del Tribunal Constitucional, y que iría en contra del derecho a la igualdad del artículo 14 de la Carta Magna, y por ende, sería una suplantación del poder constituyente, dado que para reformar dicho artículo 14 habría que acudir al procedimiento agravado que exige elecciones de nuevas Cortes Generales y referéndum popular afirmativo.

    The Spanish Official Journey has published on 17 February 2024 the amendment of article 49 of the Spanish Constitution, which goes beyond the substitution of the term “disminuido” for the term “discapacitado”, and introduces a mandate for the public institutions to an special protection for woman, as a positive discrimination which is not justified in the motivation of the Proposal on the constitutional parameters set for by the Constitutional Court, and, as a consequence could go against fundamental right of equal treatment under law of article 14 of the Constitution, producing a substitution of the constituent power of the Spanish people, which is necessary for the modification of article 14.
