Resumen de La verdad como un fin del proceso bajo una concepción garantista

  El trabajo examina la disputa entre garantistas y publicistas respecto de las facultades probatorias del juez. Se revisa la crítica que asocia tales facultades con sistemas políticos inaceptables, criticándola y matizándola, a la vez que tratando de rescatar algunas ideas de Franz Klein. Luego se examina la relación entre la verdad como fin del proceso y las posturas publicistas, por un lado, y garantista por el otro. Se rechazan los argumentos publicistas sobre la relación entre verdad y justicia, aunque se defiende la idea de que el garantismo no puede desechar completamente el rol de la verdad en el proceso, pues es necesaria para la paz social y el goce por parte de los individuos de los beneficios de la existencia de tribunales. A propósito de esto se llama la atención sobre ciertas similitudes entre las ideas de Klein y Gordon Tullock.   The paper examines the dispute between garantists and publicists regarding the evidentiary powers of the judge. We review the critique that associates such faculties with unacceptable political systems, criticizing and nuancing it, while trying to rescue some of Franz Klein's ideas. Then, we examine the relationship between truth as the end of the process and the publicist positions, on the one hand, and garantist on the other. The publicist arguments about the relation between truth and justice are rejected, although the idea that the garantism can not completely discard the role of the truth in the process is defended, because it is necessary for the social peace and the enjoyment by the individuals of the benefits of the existence of courts. Related to this idea, attention is drawn to certain similarities between the ideas of Klein and Gordon Tullock.
