    La Jurisdicción Especial para la Paz (JEP) es el componente principal del Sistema Integral de Verdad, Justicia, Reparación y No Repetición (SIVJRNR) establecido en el Acuerdo Final de Paz. La JEP responde a un modelo de justicia restaurativo que privilegia la verdad y la reparación sobre el castigo, entendido en su tradicional sentido retributivo. Sin embargo, para sus detractores, este modelo de justicia favorece la impunidad y la revictimización. El presente artículo analiza el fundamento teórico de la justicia transicional y el contexto sociopolítico que permitió el surgimiento de la JEP en Colombia. Se concluye que la justicia transicional es un producto histórico que recoge y sistematiza la experiencia de muchos países en momentos de transformación política y que fue adoptado en Colombia ante la imposibilidad de llegar a la paz por la vía militar. Con todo, su éxito dependerá de la transformación de una arraigada cultura jurídica de justicia retributiva.

    The Special Jurisdiction for Peace is the main component of the Integral System of Justice, Reparation and Non-Repetition (SIVJRNR), established in the Final Peace Agreement. The JEP responds to a model of restorative justice that favors truth and reparation over punishment understood in its traditional sense of retribution. However, for its detractors, this model of justice favors impunity and revictimization. This article analyzes the theoretical foundation of transitional justice and the sociopolitical context that took place in the emergence of the JEP in Colombia. It is concluded that justice is a historical product that gathers and systematizes the experience of many countries in the moments of deep political transformation and that was adopted in Colombia before the impossibility of reaching peace through military means. However, the success of the same will require the transformation of a deep-rooted legal culture of retributive justice.
