Refugiado climático: hacia la garantía en el ejercicio efectivo de los derechos de las personas en movilidad humana

    Los embates producidos por el cambio climático han demostrado que este fenómeno no solo es una realidad, sino que ha cambiado las condiciones de vida de millones de personas. Esto abre la puerta para que la civilización se movilice en busca de mejores condiciones para vivir y con ello se permita la libre movilidad o circulación de todos aquellos a quienes su Estado, no les ha podido garantizar la aplicación de sus derechos, y, por ende, una calidad de vida acorde a sus necesidades. El presente artículo tiene como objetivo dilucidar la necesidad de crear nuevas instituciones o estatus jurídicos específicos que protejan los derechos de las personas en movilidad humana por razones climáticas. Para la realización de este artículo se han empleado los métodos cualitativo, descriptivo y bibliográfico, que implicó revisión de material documental, doctrina y el ordenamiento jurídico nacional e internacional. Como resultado de esta investigación se encontró que existen vastas justificaciones que apuntan a la necesidad de que la comunidad internacional se pronuncie sobre el vacío legal que existe para las personas que han tenido que desplazarse forzosamente por razones climáticas. En tal razón, se puede concluir que es imperante reconocer el concepto de refugiado hacia aquellos desplazados por situaciones climáticas que se han quedado en la indefensión ante la vulneración de sus derechos. Este reconocimiento incluye aceptar que la adversidad climática es una de las razones para que las personas en movilidad humana accedan al estatus de refugiado climático y así brindarles una respuesta que les permita rehacer su vida en condiciones dignas y al amparo legal de otras jurisdicciones.

    The onslaught of climate change has shown that this phenomenon is not only a reality, but that it has changed the living conditions of millions of people. This opens the door for civilization to mobilize in search of better living conditions and thus allow the free mobility or circulation of all those to whom their State has not been able to guarantee the application of their rights and, therefore, a quality of life in accordance with their needs. The purpose of this article is to elucidate the need to create new institutions or specific legal statuses to protect the rights of people in human mobility for climatic reasons. For the realization of this article, qualitative, descriptive and bibliographic methods were used, which involved the review of documentary material, doctrine and the national and international legal system. As a result of this research, it was found that there are vast justifications that point to the need for the international community to pronounce itself on the legal vacuum that exists for people who have had to be forcibly displaced for climatic reasons. For this reason, it can be concluded that it is imperative to recognize the concept of refugee for those displaced by climatic situations who have been left defenseless in the face of the violation of their rights. This recognition includes accepting that climate adversity is one of the reasons for people in human mobility to access climate refugee status and thus provide them with a response that allows them to rebuild their lives in dignified conditions and under the legal protection of other jurisdictions.
