Resumen de Direito a ter direito: uma reflexão acerca da situação análoga à de escravo

  One of the first scenarios we come across when making a historical regression to the colonial period is slavery. The idea of a dominant body exercising power over another dominated body is not only seen in Colonial Brazil, but something called a slave-like situation is still found in our current society. This article aims to investigate the resistance of the situation analogous to that of a slave still present in current civilization and asks why the situation analogous to that of a slave still persists in the Brazilian scenario? In this condão, we will use labor, constitutional and humanist law. Thus, we will use the qualitative approach, making a rescue of the literature already produced on the subject and gathering legislative and jurisprudential data. As well as the use of hermeneutics to interpret the present texts, and the deductive method. It is concluded that although there are devices that promote the fight against a situation analogous to slavery, many of these people have low education, which hinders the knowledge of their rights and the conception of their framework in the labor context.

  Um dos primeiros cenários que nos deparamos ao fazermos uma regressão histórica para o período colonial é a escravidão. A ideia de um corpo dominante exercendo poder sobre outro corpo dominado não é visto apenas no Brasil Colônia, mas algo chamado de situação análoga a de escravo ainda é encontrado em nossa sociedade atual. O presente artigo objetiva investigar a resistência da situação análoga à de escravo ainda presente na civilização atual e indaga-se por qual razão a situação análoga a de escravo ainda persiste no cenário brasileiro? Nesse condão, utilizaremos o direito do trabalho, constitucionais e humanistas. Assim, faremos uso da abordagem qualitativa, fazendo um resgate da literatura já produzida sobre a temática e reunir dados legislativos e jurisprudenciais. Bem como o uso da hermenêutica para interpretar os presentes textos, e o método dedutivo. Conclui-se que embora haja aparatos que promovam o combate a situação análoga a de escravo, muitas dessas pessoas possuem baixa escolaridade o que obstaculariza o saber dos seus direitos e a concepção de seu enquadramento no contexto laboral.
