This paper provides general notions about the main associative crimes in the Argentine and Italian context. Its structure, its interpretative evolution and the problems it poses in relation to principles of constitutional roots are analyzed. Under these parameters, the authors raise the need for a legislative intervention aimed at clarifying the indeterminacy and ambiguity present in these criminal types in order, on the one hand, to limit excessive judicial activism and, on the other, to constitutionally guide these figures under the canons of taxativity, certainty, harmfulness and human protection.
