    En el presente artículo se aborda el tema de la rigidez y la flexibilidad de las normas de conflicto que determinan el derecho aplicable a los contratos internacionales en ausencia de elección eficaz efectuada por las partes. Los objetivos perseguidos son explorar cómo se va abriendo paso en América Latina la flexibilidad en esta materia, manifestada en el principio de proximidad, e identificar y analizar las funciones que la proximidad cumple en el ámbito de la contratación internacional en instrumentos y sistemas jurídicos de la región. Para lograrlos, se realiza un estudio y se propone una clasificación de las normas vigentes, distinguiendo a qué modelo corresponden y qué funciones tiene la proximidad. Asimismo, se constata una tendencia a migrar hacia modelos que permiten recurrir al criterio de los vínculos más estrechos.

    This article addresses the issue of the rigidity and flexibility of the conflict rules that determine the law applicable to international contracts in the absence of an effective choice made by the parties. The objectives pursued are to explore how flexibility, manifested in the principle of proximity, is making its way in Latin America, and to identify and analyse the functions that proximity fulfils in the field of international contracting in legal instruments and legal systems of the region. To achieve them, a study is carried out and a classification of the current regulations is proposed, distinguishing which model they correspond to and what functions proximity has. Likewise, a tendency to migrate towards models that allow resorting to the criterion of the closest ties is verified.
