    En este trabajo se analiza la jerarquía de los tratados internacionales sobre Derechos Humanos y de las sentencias de la Corte Interamericana de Derechos Humanos conforme a las reglas del sistema constitucional argentino. En tal sentido, se sostiene la existencia de un margen de apreciación a favor de las autoridades nacionales –legislativas y jurisdiccionales– respecto de la interpretación y aplicación del derecho internacional, del mismo modo que existe un margen de apreciación provincial respecto del gobierno federal.

    This paper analyzes the hierarchy of international treaties on Human Rights and the sentences of the InterAmerican Court of Human Rights in accordance with the rules of the Argentine constitutional system. In this regard, the existence of a margin of appreciation in favor of national authorities –legislative and jurisdictional– regarding the interpretation and application of international law is maintained, in the same way that there is a margin of provincial appreciation with respect to the federal government.
