    Pese a que la figura el anatocismo desapareció de la legislación mexicana, existen dentro de la legislación, distintas prácticas como son los contratos de crédito adicional, de restructura de crédito, los de refinanciamiento y el cobro de interés sobre interés, que tienen el mismo fin, el cobro excesivo de intereses. Estas prácticas de cobro se ejecutan mediante las empresas bancarias y financieras que repercuten en diversas violaciones a los derechos humanos de los solicitantes de créditos, los cuales quedan en un estado de indefensión frente a los múltiples derechos y beneficios que el Estado otorga a dichas instituciones. Por lo tanto, este articulo pretende identificar porque se dio lugar a estas prácticas de cobro, en qué manera se asemejan a la práctica anatocistas y cómo repercute en los derechos humanos de los deudores crediticios la manera en que se dirigen las instituciones bancarias y financieras.

    Despite the fact that the figure of anatocism disappeared from Mexican legislation, there are within the legislation, different practices such as additional credit contracts, credit restructuring, refinancing and the collection of interest on interest, which have the same purpose, the excessive charging of interest. These collection practices are carried out by banking and financial companies that affect various violations of the human rights of loan applicants, who are left in a state of defenselessness in the face of the multiple rights and benefits that the State grants to said institutions. Therefore, this article aims to identify why these collection practices took place, in what way they resemble the anatocist practice and how the way in which banking and financial institutions are conducted affects the human rights of credit debtors.
