Resumen de Crimes contra mulher por razões da condição de sexo feminino: Quais corpos são protegidos?

  This article aims to analyze the types of criminal penalties that relate to women who are victims of violence, considering that most gender-based violence victims are women, regardless of the body that represents them. It notes a problem with respect to differences in terminology between the Maria da Penha Law and the Brazilian Penal Code, since the differences have a negative impact on the scope of state protection. The objective is to reflect on the fact that the core of violence against women is deep and structural, transcending the physical realm, permeating the collective consciousness articulated by patriarchy and misogyny, which result in hierarchies, a sense of ownership, and superiority over women. Through bibliographic research, it is concluded that current doctrine and jurisprudence adhere to the scope established by the Maria da Penha Law, but the debate presented in this article is far from concluding.

  Este artigo destina-se a analisar os tipos penais quando se referem à mulher vítima de violência, dado que o perfil prioritário das vítimas de violência de gênero são mulheres independentemente do corpo que a representa. Problematiza-se acerca das distinções terminológicas entre a Lei Maria da Penha e o Código Penal brasileiro, uma vez que essas distinções impactam negativamente no âmbito de proteção estatal. Como tal, tem como objetivo refletir que o cerne da violência contra mulher é profundo e estrutural, transcendendo o corpóreo, permeando o consciente coletivo articulado pelo patriarcado e o machismo que resulta em hierarquias, sentimento de posse e superioridade ante a mulher. Por intermédio de pesquisa bibliográfica, conclui-se que a doutrina e a jurisprudência atuais seguem a abrangência estabelecida pela Lei Maria da Penha, porém o debate travado neste artigo está longe de se finalizar.
