Resumen de Posible vicio de ilegalidad y concurrencia "ultra vires" del arbitraje configurado en el Reglamento del Mercado Oficial de Opciones y Futuros Financieros en España

El autor de este trabajo manifiesta su opinión sobre el posible vicio de ilegalidad en que incurre el vigente Reglamento MEFF, al dejar en manos de una de las partes la designación del árbitro si la otra no lo designa. Además, considera que el sistema arbitral previsto en ese Reglamento puede incurrir en ultra vires respecto a la Ley española de Arbitraje y tratados y convenios internacionales.

The author of this paper expresses his opinion on the possible illegality of the current MEFF Regulations, by leaving the appointment of the arbitrator in the hands of one of the parties if the other party does not appoint one. Furthermore, he considers that the arbitration system provided for in these Regulations may be ultra vires with respect to the Spanish Arbitration Law and international treaties and conventions.
