    Este artículo explora las complejidades del feminicidio, centrándose en la tipología del delito y la importancia del enfoque de género. Se plantea la cuestión central de si el feminicidio representa principalmente un desafío legal o ideológico. La primera sección aborda la necesidad de establecer un tipo penal específico para el feminicidio, cuestionando si podría considerarse simplemente una categoría especial de homicidio o si requiere normativas particulares. La segunda sección examina la razón fundamental detrás de esta necesidad, analizando la regulación de situaciones en las que se mata por razón de la condición de mujer. La tercera sección explora la complejidad judicial de probar la motivación por odio hacia la mujer (misoginia) en casos de feminicidio, destacando los desafíos prácticos y legales asociados.

    This article explores the complexities of femicide, focusing on the typology of the crime and the importance of the gender approach. It raises the central question of whether femicide primarily represents a legal or ideological challenge. The first section addresses the need to establish a specific criminal type for femicide, questioning whether it could be considered simply a special category of homicide or if it requires particular regulations. The second section examines the fundamental reason behind this need, analyzing the regulation of situations where killing occurs due to a woman's condition. The third section explores the judicial complexity of proving motivation by hatred towards women (misogyny) in cases of femicide, highlighting associated practical and legal challenges.
