    O presente artigovisa contribuir para aconstrução deuma concepção de cegueira deliberada consentânea com o direito penal em países de tradição romano-germânica. Nessa tarefa, são utilizadas as premissas epistemológicas fornecidas pela concepção significativa de ação, a qual é calcada na viragem linguístico-pragmática característica da filosofia da linguagem. A partir da perspectiva linguística, compreende-se adequadamente a cegueira deliberada no direito continentale se percebe o valor que esta tem como fator indicativo qualificado do significado do elemento cognitivo do dolo.O trabalho se insere na perspectiva de que a teoria do delito deve abandonar a busca da descrição da “verdade”, passando a almejar uma pretensão de realização de “justiça”

    This paper aims to construe a conception of willful blindness compatible with the criminal lawof civil law countries.For this task, we use the epistemological assumptions given by the meaningful action conception, which is based upon the linguistic and pragmatic turn provided by the philosophy of the language. Based on the linguistic perspective, we are able to understand adequately the willful blindness in the context ofthe criminal law ofcivillawcountriesand we can perceive its value as a qualified indicative factor about the cognitive element of themens rea. This paper considers that the theory of crime must abandon the aim of describing the “truth”, instead, it should focus on the intent to make “justice”
