Resumen de Incumplimiento del pago del acta de finiquito en caso de terminación de la relación laboral por mutuo acuerdo y sus implicaciones jurídicas cohercitivas

  El presente proyecto tiene como finalidad investigar los derechos que tiene el trabajador a recibir el pago de finiquito al terminar la relación laboral, por renuncia por mutuo acuerdo del mismo, generándose situaciones de impago o retardo en la satisfacción del mismo, lo que genera la vulneración de los derechos del trabajador; cuya finalidad es garantizar el derecho al trabajador, específicamente en el finiquito, los cuales están desarrollados y establecidos en la Constitución, Convenios y Tratados Internacionales y el Código de Trabajo vigente en Ecuador.

  Así mismo se aplicaron instrumentos de investigación cuya finalidad es comprobar si realmente se cumple de manera efectiva por parte del empleador el pago del finiquito al terminar la relación laboral y verificar si es necesario la reforma del Código de Trabajo para que sean insertadas medidas coercitivas que garanticen el pago del finiquito.

  The purpose of this project is to investigate the rights of the worker to receive the settlement payment upon termination of the employment relationship, by waiver by mutual agreement, generating situations of non-payment or delay in the satisfaction thereof, which generates the violation of worker's rights; whose purpose is to guarantee the right to the worker, specifically in the settlement, which are developed and established in the Constitution, International Agreements and Treaties and the Labor Code in force in Ecuador.

  Likewise, research instruments were applied, the purpose of which is to verify if the employer actually pays the termination payment at the end of the employment relationship and to verify if it is necessary to reform the Labor Code so that coercive measures that guarantee the payment of the settlement.
