Rechazos en frontera. Una violación sistemática de derechos humanos con respaldo institucional. ¿Hacia la normalización de una frontera sin derechos?

    El rechazo en frontera es la pretendida cobertura legal de devoluciones sumarias que vulneran derechos humanos de personas que pretenden entrar en el territorio español. Se trata de unas actuaciones contrarias al derecho internacional de los derechos humanos que, sin embargo, han sido defendidas por el Gobierno de España. El Tribunal Europeo de Derechos Humanos y el Tribunal Constitucional han mostrado su respaldo a la práctica de devoluciones automáticas en la frontera de Ceuta y Melilla, y el Nuevo Pacto sobre Migración y Asilo parece abrir la puerta a derogaciones de derechos humanos en la frontera que permitirían favorecer una vía de hecho que contraviene las obligaciones internacionales de España.

    Border rejection is the alleged legal cover for summary returns that violate the human rights of individuals seeking entry into Spanish territory. These actions are contrary to international human rights law, yet they have been defended by the Spanish government. The European Court of Human Rights and the Constitutional Court have expressed their support for the practice of automatic returns at the borders of Ceuta and Melilla, and the New Pact on Migration and Asylum appears to open the door to human rights derogations at the border that would enable the lack of guarantees and procedures that contravenes Spain's international obligations.
