    Resumen El presente trabajo tiene por objeto analizar los elementos y valorar críticamente la regulación del delito establecido en el artículo 443 del Código Orgánico de Tribunales. Utilizando una metodología fundamentalmente dogmática, el texto menciona los antecedentes históricos del delito y examina la técnica legislativa utilizada para describirlo. Asimismo, analiza los aspectos objetivos y subjetivos del tipo, destacando varios problemas que genera su actual regulación, especialmente desde un punto de vista sistemático y valorativo.

    Abstract The purpose of this paper is to analyze the elements and critically assess the regulation of the crime established in article 443 of the Organic Code of Courts. Using fundamentally a dogmatic methodology, the text mentions the historical background of the crime and examines the legislative technique used to describe it. Likewise, it analyzes the objective and subjective aspects of the legal description of the crime, highlighting various problems generated by its current regulation, especially from a systematic and evaluative point of view.
