    En el entorno empresarial actual, existe una opinión generalizada de la importancia de las investigaciones internas como elemento esencial de todo modelo o sistema de gestión de compliance. Como último punto de inflexión en España, la transposición de la Directiva Whistleblowing, a través de la Ley de Protección al Informante, ha supuesto un despertar para muchas organizaciones poniendo de manifiesto la necesidad de contar con pautas específicas y homogenización de criterios a la hora de preservar todos los derechos y garantías de las personas implicadas en una investigación. Añadiendo un grado extra de complejidad a estos procesos de investigación, en este artículo se abordará el auge de las investigaciones cross-border en las que varias jurisdicciones, con sus respectivos marcos jurídicos, se ven implicadas. Asimismo, este artículo busca ilustrar no solo los factores esenciales y la evolución normativa de las investigaciones internas sino también mención especial al impacto de la publicación, el pasado mes de julio, del estándar internacional ISO 37008:2023, Internal investigations of organizations, como punto de partida a la hora de elaborar pautas generales corporativas, especialmente en empresas multinacionales.

    In a modern business environment, there is a generalised opinion of the importance of internal investigations as an essential element of any compliance model or compliance management system (CMS). The latest step forward in Spain, the transposition of the Whistleblowing Directive, through the Whistleblower Protection Act in Spain, has been a wake-up call for many organisations, highlighting the need for specific guidelines and homogenisation of criteria when it comes to preserving all the rights and guarantees of the people involved in an investigation. Adding an extra degree of complexity to these investigation processes, this article will address the rise of cross-border investigations in which several jurisdictions, with their respective legal frameworks, are involved. Furthermore, this article seeks to illustrate not only the essential factors and regulatory developments in internal investigations, but also to highlight the impact of the publication last July of the international standard ISO 37008:2023, Internal investigations of organisations, as a starting point for developing general corporate guidelines, especially in multinational companies.
