El objetivo principal de la investigación fue determinar si la aplicación simultánea de la justicia indígena y la justicia ordinaria vulnera o no el precepto constitucional de prohibición de la doble incriminación, conocido a menudo como principio nom bis in ídem. Esto se deriva del objetivo, que buscó determinar si ya no es necesaria la aplicación de la justicia ordinaria una vez aplicada la justicia indígena, dado que ninguna persona puede ser procesada dos veces por el mismo delito. Esta investigación se centró en la aplicación e interpretación precisa del concepto non bis in ídem de acuerdo con la autoridad judicial e indígena que conforma el marco de justicia reconocido en el Ecuador. Para lograr este objetivo, se realizó un estudio cualitativo con la metodología de revisión y fundamentación teórica basada en bibliografía jurídica constitucional, artículos, códigos, sentencias y libros. Esto se hizo para que a través de un enfoque integrador del análisis y de los objetivos planteados sobre la exacta y debida aplicación de la justicia y las consecuencias que genera, se pueda confirmar si la justicia indígena impacta el principio nom bis in ídem. El método que se utilizó fue el analítico.
The main objective of the research was to determine whether or not the simultaneous application of indigenous justice and ordinary justice violates the constitutional precept of prohibition of double jeopardy, often known as the nom bis in idem principle. This is derived from the objective, which sought to determine whether it is no longer necessary to apply ordinary justice once indigenous justice has been applied, given that no person can be prosecuted twice for the same crime. This research focused on the application and precise interpretation of the concept of non-bis in idem according to the judicial and indigenous authorities that conform to the framework of justice recognized in Ecuador. To achieve this objective, a qualitative study was carried out with the methodology of review and theoretical foundation based on constitutional legal bibliography, articles, codes, sentences, and books. This was done so that, through an integrated approach to the analysis and the objectives set out for the exact and due application of justice and the consequences it generates, it can be confirmed whether indigenous justice impacts the nom bis in idem principle. The method used was analytical.
