    La inclusión social y la integración de las personas con beneficios de ley o régimen semiabierto tienen como objetivo reinsertar al individuo de manera activa y responsable en la sociedad, fortaleciendo el tipo de cualidades, que le permitan generar un sustento a través de la integración al trabajo convirtiéndose este en columna vertebral para promover el desarrollo y la integración de dichas personas. Los mecanismos judiciales tienen como objetivo incentivar, promover y facilitar a través de las normas los derechos que se encuentran dentro de la Constitución, entre ellos se garantiza, el derecho al trabajo. Por tal motivo es importante que se articulen en una misma dirección tanto las responsabilidades legales del individuo con los centros de privación de libertad como, sus responsabilidades laborales, ya que el trabajo permite un desarrollo pleno en todos los contextos de la vida de una persona. Esto permitiría a su vez, una verdadera reinserción social. Por tal motivo es de vital importancia poder establecer el equilibrio entre las medidas de beneficios de régimen y las condiciones que otorgan los jueces penitenciarios al momento de conceder un beneficio de régimen. La metodología usada en el desarrollo del artículo es con un enfoque cualitativo, ya que se empleó el método bibliográfico documental al revisar diferentes tratadistas que hablan acerca de la temática en mención.

    The social inclusion and integration of persons with legal benefits or semi-open regime have the objective of reinserting the individual in an active and responsible manner in society, strengthening the type of qualities that allow him/her to generate a livelihood through the integration of work, which becomes the backbone to promote the development and integration of such persons. The judicial mechanisms aim to encourage, promote and facilitate through the rules the rights found in the Constitution, among them is guaranteed the right to work. For this reason, it is important to articulate in the same direction both the legal responsibilities of the individual with the centers of deprivation of liberty and his or her work responsibilities, since work allows for full development in all contexts of a person's life. This, in turn, would allow for true social reintegration. For this reason it is of vital importance to be able to establish the balance between the measures of regime benefits and the conditions granted by prison judges at the time of granting a regime benefit. The methodology used in the development of the article is a qualitative approach, since the documentary bibliographic method was used to review different treatises that talk about the subject in question.
