Resumen de La codificación del ius commune romano en la Argentina

En el presente trabajo haremos referencia a la recepción del ius commune romano en la legislación argentina. Nos proponemos indagar si, así como el artículo 16 del Código de Vélez establecía el reenvío a los principios generales del Derecho, para integrar el ordenamiento jurídico argentino con los principios de todo el sistema jurídico romanista, la redacción del actual artículo 2 del Código Civil y Comercial de la Nación, implica un apartamiento de la tradición romana e hispánica.

In the present work we will refer to the reception of the Roman ius commune in the Argentine legislation. We intend to investigate whether, just as article 16 of the Vélez Code established the referral to the general principles of law, to integrate the Argentina legal system with the principles of the entire roman law system, the wording of the current article 2 of the Civil and Commercial Code of the Nation, implies a deviation from the roman and Hispanic tradition.
