    Los Furs de València del rey Jaume I no contienen una rúbrica relativa al damnum infectum como sí sucede en el Digesto. Así, no construyen un régimen jurídico sobre el daño temido, sino que lo abordan integrándolo en tres pasajes que solo permiten suponer el régimen de la institución. El trabajo analiza las causas del poco tratamiento en los Furs de esta tutela civil preventiva en el contexto de las relaciones de vecindad, a través del análisis de los textos romanos y de los del ius commune.

    The Furs of València of King Jaume I do not contain a rubric related to damnum infectum as it does in the Digest. Thus, they do not build a legal regime on the feared damage, it is addressed by integrating it into three passages, that only allow us to assume the regime of the institution. The work analyses the causes of the scarce treatment in the Furs of this preventive civil guardianship in the context of neighbourhood relations, through the analysis of Roman Law texts and those of the ius commune.
