Si bien Francisco de Vitoria se inspiró en el ius gentium de Gayo (Gai. 1.1, I.1.2.1) para definir su Derecho de gentes (De Indis, III.2), elaboró un concepto distinto al gayano porque lo fundamentó en el consenso general de las naciones («gentes»), además de la razón natural. Por ello, fue «ius inter gentes» que restó centralidad a los seres humanos. No obstante, reflexionar sobre ambos permite identificar sus aportes al desarrollo del Derecho internacional contemporáneo.

Although Francisco de Vitoria was inspired by Gaius’ ius gentium (Gai. 1.1, I.1.2.1) in order to define his law of the nations (De Indis, III.2), he developed a different concept because he based it on the general consensus of nations («gentes»), in addition to natural reason. Therefore, it was «ius inter gentes» that reduced the centrality of human beings. However, reflecting on both concepts allows us to identify their contributions to the development of contemporary International Law.
