    El objetivo general de la investigación fue analizar jurídicamente la determinación de la mutación constitucional a la institución jurídica del matrimonio igualitario en el Ecuador. La investigación se desarrolló desde el enfoque cualitativo, se hizo uso de varias fuentes bibliográficas a fin de conseguir información real y actualizada para poder alcanzar el objetivo planteado frente al problema jurídico en análisis. La técnica de investigación aplicada fue la entrevista, a un grupo de informantes clave. Se concluye que, la Corte Constitucional goza de la facultad de interpretar la constitucionalidad de las normas, decretos, entre otras, y las sentencias y dictámenes dictados por esta Corte, son definitivos e inapelables, se puede observar que en la actualidad se encuentran extralimitándose y ya no solo interpretando, por el contrario, se encuentran legislando por medio de sestas sentencias al ser de carácter vinculante y de aplicación inmediata.

    The general objective of the research was to legally analyze the determination of the constitutional mutation to the legal institution of egalitarian marriage in Ecuador. The research was developed from a qualitative approach, using several bibliographic sources in order to obtain real and updated information to achieve the objective set against the legal problem under analysis. The research technique applied was the interview to a group of key informants. It is concluded that the Constitutional Court has the power to interpret the constitutionality of the norms, decrees, among others, and the sentences and opinions issued by this Court are final and unappealable, it can be observed that currently they are overreaching and not only interpreting, on the contrary, they are legislating by means of these sentences as they are binding and of immediate application.
