Resumen de Afirmação, especificação e multiplicação dos direitos humanos frente às concepções organicista e mecanicista de Estado de Norberto Bobbio

The affirmation of human rights in the modern period occurred mainly with the declarations of rights of the United States (1776) and of France (1789) and the Universal Declaration of Human Rights (1948). After approval of the Charter of 1948 by the UN General Assembly occurred the specification and human rights multiplication. This article revisits these events and documents, makes the description of its features and points out the causes of the detailing (especificacion) and the increase (multiplication) of human rights. The work also exposes the organismic and mechanistic theories of the state, showing that the first priority in relation to all its parts as the second works with reverse rationality, prioritizing its parts in the whole. The objective of this article is to present the evolution of human rights in the modern period and find out how the organismic and mechanistic theories can be articulated and dialogue with such rights, if both can really. A afirmação dos direitos humanos na era moderna se deu principalmente com as declarações de direitos dos Estados Unidos (1776) e da França (1789) e com a Declaração Universal dos Direitos do Homem (1948). Após aprovação da Carta de 1948 pela Assembleia das Nações Unidas ocorreram os fenômenos da especificação e da multiplicação dos direitos do homem. O presente artigo revisita esses eventos e documentos, faz a descrição de suas características e aponta as causas do detalhamento (especificação) e do incremento (multiplicação) dos direitos humanos. O trabalho também expõe as teses organicista e mecanicista do Estado, demonstrando que a primeira prioriza o todo em relação a suas partes, enquanto a segunda labora com racionalidade inversa, priorizando suas partes em relação ao todo. O objetivo do artigo é apresentar a evolução dos direitos humanos na era moderna e averiguar como as teorias organicista e mecanicista podem se articular e dialogar com tais direitos, se é que ambas podem mesmo. O texto tem por referencial teórico principalmente a obra A era dos direitos, de Norberto Bobbio.
