La Rectoria Constitutional como poder autoritario

    En este artículo, me propongo demostrar que la introducción, en la Constitución de la República, de la "rectoría" como atribución del Presidente es resultado de una concepci6n del poder bajo un sistema hiperpresidencialista, que al mismo tiempo que define un estado de derecho, deriva en el ejercicio autoritario del poder. Analizo la rectoría en los espacios reales de la administración pública, es decir, del poder del Presidente de la Republica, como jefe de gobierno: En el Plan Nacional de Desarrollo, en el Presupuesto General del Estado, en los Gobiernos Autónomos Descentralizados, y en las Fuerzas Armadas. Termino descubriendo el origen teórico e histórico y los riesgos de la Rectoría Presidencial para la democracia y para los derechos de los ciudadanos y la resistencia del pueblo en contra de un sistema político autoritario.

    In this article, I propose to demonstrate that the introduction, in the Constitution of the Republic, of the "rectory" as attribution of the President is the result of a conception of power under a hyper-presidential system, which at the same time defines a state of law, derives from the authoritarian exercise of power. I analyze the rectory in the real spaces of the public administration, that is, the power of the President of the Republic, as head of government: In the National Development Plan, in the General Budget of the State, in the Decentralized Autonomous Governments, and in the Armed Forces. I finish discovering the theoretical and historical origin and the risks of the Presidential Rectory for democracy and for the rights of the citizens and the resistance of the people against an authoritarian political system.
