Régimen de visitas, comunicaciones y estancia de los hijos menores en caso de violencia: exégesis de los apartados IV y V del artículo 94 CC

    El pasado 21 de octubre de 2022 se publicaba la STC (de Pleno) 106/2022, de 13 de septiembre, con ocasión del recurso de inconstitucionalidad interpuesto contra la reforma del art. 94 CC (operada mediante la Ley 8/2021, de 2 de junio). El precepto suscitó la polémica en el ámbito político, jurisdiccional y doctrinal, al entenderse una injerencia al poder judicial (art. 117 CE), al derecho a la tutela judicial efectiva y a la presunción de inocencia (art. 24 CE) y a la seguridad jurídica (art. 9.3 CE), en relación con el art. 39 CE. El TC, lejos de declarar la inconstitucionalidad de la citada norma, también se mostró dividido, lo que confirma el debate de una realidad poco pacífica. Así, con el afán de aclarar el contenido de los apdos. IV y V del art. 94 CC, mediante este trabajo se propone un estudio interpretativo completo, recurriendo a la tradicional escuela exegética.

    Esta investigación tiene por objeto analizar los antecedentes legislativos más próximos del precepto, la gramática empleada, su contextualización respecto a otras normas del ordenamiento y el alcance de su finalidad y espíritu; todo ello a través de los distintos criterios hermenéuticos expuestos en el art. 3.1 CC. En cuanto a las fuentes empleadas para dar respuesta a la pretensión, se recurre principalmente a las normas nacionales e instrumentos internacionales que inciden en la protección de los menores y de la mujer, así como a los postulados doctrinales y jurisprudenciales de mayor relevancia, teniendo presente la novedad de la redacción del precepto en cuestión.

    Por el debate suscitado y los problemas interpretativos del art. 94 apdo. IV y V CC, se interesa un estudio amplio del precepto, que pretenda encontrar la verdad científica o, al menos, una aproximación.

    On 21 October 2022, the STC (Plenary) 106/2022, of 13 September, was published on the occasion of the appeal of unconstitutionality filed against the reform (operated using Law 8/2021, of 2 June) of art. 94 CC. The precept aroused controversy in the political, jurisdictional and doctrinal spheres, as it was understood to be an interference with judicial power, the right to adequate judicial protection, legal certainty and the presumption of innocence, with an impact on art. 39 CE. The TC, far from declaring the unconstitutionality of the rule above, was also divided, which confirms the debate of a not very peaceful reality. Thus, to clarify the content of sections IV and V of Art. 94 CC, this work proposes a complete interpretative study, resorting to the traditional exegetical school.

    This research aims to analyse the closest legislative antecedents of the precept, the grammar used, its contextualisation concerning other norms of the legal system and the scope of its purpose and spirit, all through the different hermeneutic criteria set out in art. 3.1 CC. As for the sources used to respond to the claim, recourse is mainly had to national regulations and international instruments that have an impact on the protection of minors and women, as well as the most relevant doctrinal and jurisprudential postulates, bearing in mind the novelty of the wording of the precept in question.

    Due to the debate that has arisen and the interpretative problems of Art. 94 para. IV and V CC, a broad study of the precept, which aims to find the scientific truth or, at least, an approximation, is of interest.
