Resumen de Estudio comparado sobre la clasificación del suelo y la regulación de los Núcleos Rurales en España

En este artículo se presenta el estudio comparado de la normativa autonómica sobre la clasificación y regulación del suelo de los Núcleos Rurales en España. Tras contextualizar su importancia en relación con las peculiaridades del sistema de asentamientos rurales en las diferentes Comunidades Autónomas se repasan los principales conceptos generales relacionados con los Núcleos Rurales, su definición y las categorías de suelo en que se enmarcan. Se analizan también los criterios para la delimitación de los Núcleos Rurales y su régimen urbanístico, así como la relación entre la regulación de los Núcleos Rurales y la vivienda unifamiliar aislada en Suelo Rústico o No Urbanizable. Finalmente, se desarrollan unas conclusiones entre las que destacan no sólo las principales insuficiencias de la regulación actual y la necesidad de mejorar ésta desde el punto de vista de técnica normativa y de una mayor atención a los aspectos morfotipológicos, patrimoniales y paisajísticos, sino también de la imprescindible urgencia de una reflexión que trascienda los aspectos urbanísticos y plantee un verdadero cambio de paradigma facilitando otras alternativas económicas reales para el medio rural más allá del simple crecimiento inmobiliario.

This article presents a comparative study of the regional regulations on the classification and regulation of land in Rural Nuclei in Spain. After contextualizing its importance in relation to the peculiarities of the rural settlement system in the different Autonomous Communities, the main general concepts related to Rural Nuclei, their definition and the categories of land in which they are framed, are reviewed. The criteria for the delimitation of the Rural Nuclei and their urban regime of legal rights and duties are also analyzed, as well as the relationship between the regulation of the Rural Nuclei and the promotion of isolated single-family housing on Rustic or Non-Developable Land. Finally, some conclusions are presented, among which stand out not only the main shortcomings of the current regulation and the need to improve it from the point of view of normative technique and a greater attention to morphotypological, patrimonial and landscape aspects, but also of the essential urgency of a broader reflection proposing a true paradigm shift facilitating other real economic alternatives for the rural environment beyond simple real estate growth.
